Please read these Terms of Service carefully before using the ControlTemp platform. By creating an account or using our service, you agree to be bound by these terms. If you do not agree, do not use the service.
ControlTemp ("we", "us", "our") is a South African IoT temperature monitoring service operated from Durban, KwaZulu-Natal, South Africa. We provide hardware devices, firmware, a cloud dashboard, and SMS alerting to businesses that need to monitor refrigeration equipment.

To use the Service you must create an account with accurate business and contact information. You are responsible for keeping your login credentials confidential. You must notify us immediately at info@controltemp.co.za if you suspect unauthorised access to your account.
You may not share your account credentials with third parties or create accounts on behalf of others without their consent.
Fees are charged as agreed at the time of purchase (once-off hardware cost plus a recurring monthly or annual service fee). Current pricing is displayed on our website. All prices are in South African Rand (ZAR) and exclude VAT unless otherwise stated.
Monthly or annual fees are due in advance. Failure to pay within 14 days of the due date may result in suspension of your account and dashboard access. Hardware supplied on credit terms remains the property of ControlTemp until paid in full.
We will give you at least 30 days' written notice (by email to your registered address) before increasing your recurring fees.
If you are on a rental plan, the Hardware remains ControlTemp's property at all times. You must return it in good working condition upon cancellation. Damage beyond normal wear and tear will be invoiced at repair or replacement cost.
We aim for 99% uptime of the dashboard and API endpoints measured monthly, excluding scheduled maintenance and force majeure events. Scheduled maintenance will be announced at least 24 hours in advance where possible.
We do not guarantee uninterrupted service. GSM connectivity depends on South African mobile networks (Vodacom, MTN, Cell C, etc.) which are outside our control. Network outages, poor signal, or carrier-side issues may prevent data transmission. SMS delivery is provided on a best-efforts basis through Africa's Talking and is subject to carrier limitations.
The Service is provided as a monitoring aid. It must not be used as the sole safety system for food safety compliance or any other life-critical application.
All temperature readings, GPS trails, and device telemetry posted from your Hardware to our servers ("Your Data") remain your property. We process and store it solely to provide the Service to you.
We retain Your Data for a rolling period of 12 months on our servers. Data older than 12 months may be automatically deleted. You are responsible for exporting and archiving any data you need to retain for compliance purposes using the CSV/PDF export features in the dashboard.
We will not sell, share, or disclose Your Data to third parties except as required by South African law or court order, or as strictly necessary to provide the Service (e.g. SMS delivery via Africa's Talking).
The ControlTemp dashboard software, API, firmware source code (as supplied to you), branding, and documentation are our intellectual property. You are granted a non-exclusive, non-transferable licence to use them solely for operating your monitored equipment.
Where we supply firmware source code, you may modify it for use on hardware you own. You may not redistribute modified firmware or the dashboard software commercially without written consent.
To the maximum extent permitted by South African law:
The Service is a monitoring and notification tool. Compliance with HACCP, food safety regulations, or any other regulatory framework remains entirely your responsibility.
You agree to indemnify and hold ControlTemp harmless from any claims, losses, or expenses (including legal costs) arising from your misuse of the Service, breach of these Terms, or violation of any applicable law.
You may cancel your subscription at any time by emailing info@controltemp.co.za. Cancellation takes effect at the end of your current billing period. No refunds are issued for unused portions of a prepaid period.
We may suspend or terminate your account immediately if you breach these Terms, fail to pay fees, or use the Service in a way that endangers our infrastructure or other customers. We will give 7 days' notice for non-payment terminations where possible.
Upon termination, your access to the dashboard and API will be revoked. Your Data will be retained for 30 days after termination during which you may export it. After 30 days it will be permanently deleted. Rental Hardware must be returned within 14 days of termination.
We may update these Terms from time to time. We will notify you by email at least 14 days before material changes take effect. Continued use of the Service after that date constitutes acceptance of the new Terms.
These Terms are governed by the laws of the Republic of South Africa. Any disputes shall be subject to the exclusive jurisdiction of the South African courts. We will always try to resolve disputes amicably first — contact us at info@controltemp.co.za.
